1. Platform Hosting & Analytics Disclosure

Platform Disclosure: OSBARD, INC. operates two distinct digital environments with different data profiles:

The Osbard Studio App: A private, “Zero-Data” creative tool utilizing LocalStorage. We do not require account creation and do not collect user data within the app. We utilize Plausible.io for anonymous, aggregated, and cookieless analytics to ensure app stability without tracking individuals.

Osbard.com Website: Our landing page, newsletter, and Substack-hosted content (including Chronicles, Notes, and About pages) utilize Google Analytics (GA4) for site optimization. These tracking tools are strictly prohibited from running within the Osbard Studio App environment to maintain our “Zero-Data” commitment for creators.

2. Children’s Privacy Policy (COPPA Notice)

Osbard Studio (OSBARD, INC.) is a “Zero-Data” creative environment. We believe children should be free to create without being tracked, profiled, or monetized.

A. The “Zero-Data” App Environment

• No Accounts: We do not require registration, names, or accounts to use our creative tools.
• Local Storage: All artwork, character designs, and projects stay on the user’s device (browser cache). OSBARD, INC. cannot see, access, or store your child’s creative work.
• No Passive Tracking: We do not use cookies or IP tracking within the Studio app.

B. Platform Hosting Disclosure (Substack)

Our primary website and newsletter are hosted by Substack Inc.

• Standard Logs: When a user visits osbard.com, Substack automatically collects limited technical data (such as IP addresses and device identifiers) for security and standard web operations.
• Newsletter: We do not knowingly market to or collect email addresses from children under 13. If a parent chooses to subscribe to our newsletter, Substack manages that data according to their separate Privacy Policy.

C. Data Retention & Deletion

• Direct Contact Only: We only receive personal data if a parent/guardian emails us directly.
• Immediate Deletion: We do not retain children’s data. If we discover we have inadvertently received personal information from a child under 13, we delete it immediately.
• No Third-Parties: We do not sell, share, or disclose any information to third-party advertisers or data brokers.

D. Parental Rights

Under COPPA, parents have the right to review, request deletion of, or refuse further collection of any personal information we have received via direct email.

Human Creator Guarantee & AI Usage Policy

OSBARD, INC. is committed to the integrity of human creativity. All creative works—including narrative text, illustrations, character designs, and the visual UI/UX of our digital tools—are 100% human-conceived and designed.

We utilize Artificial Intelligence strictly for informational support and technical engineering to bring our original designs to life. We do not use generative AI to produce any end-user stories, artwork, or the core aesthetic vision of the Osbard brand.

5. Do Not Sell or Share My Personal Information

OSBARD, INC. does not sell your personal information for money.

• Privacy-First Architecture: We do not use third-party ad cookies, data brokers, or behavioral tracking within the Osbard Studio app.
• Platform & Analytics Disclosure: Our landing page and newsletter (osbard.com) utilize Substack and Google Analytics (GA4). These platforms may “share” limited technical data (such as IP addresses) across their networks for site optimization and content recommendations. This is governed by their respective privacy policies and is active only on the landing page environment.
• Automated Signals (GPC): We recognize and honor Global Privacy Control (GPC) signals. If your browser sends this signal, our platform will automatically treat it as a request to opt-out of the “sharing” of your data for Substack’s network recommendations.
• Manual Opt-Out: To formally exclude your email or data from any potential platform-level sharing or future transactions, please Email: opt-out-request@osbard.com.

6. GDPR Privacy Notice (EEA/UK/CH)

Data Processors: We utilize vetted third-party processors to provide our services:

• Substack Inc.: For website hosting and newsletter delivery.

Minimal Processing:

• The Studio App: Your creative work is stored exclusively in your browser’s LocalStorage. OSBARD, INC. does not access, process, or store your artwork or project files.
• Website & Newsletter: We process your email address only if you voluntarily subscribe to our updates or contact us directly. Standard technical metadata (IP addresses) is processed by our hosting and analytics partners on the landing page only.

7. Privacy Policy

Architecture & Analytics:

• The Studio App: Uses “LocalStorage.” Your drawings and project files are never uploaded to our servers. We utilize Plausible.io for anonymous, aggregated, and cookieless analytics to ensure app health without tracking individuals.
• Website Hosting: Osbard.com is hosted by Substack Inc. Technical metadata (IP addresses) is collected by Substack for site operations.
• Analytics: We use Google Analytics (GA4) and Plausible.io to understand traffic on osbard.com. To protect our “Zero-Data” promise for creators, GA4 is strictly prohibited from running within the Osbard Studio creative environment.

Data We Collect:

• Voluntary Data: Email addresses provided via newsletter subscription or direct contact.
• Usage: Data is used strictly for community communication, technical optimization of the Studio, and legal compliance. We do not sell or rent your personal information.
• Security: All traffic is protected via SSL/TLS encryption. We prioritize a “Zero-Data” footprint to minimize security risks.

8. Terms and Conditions

• Ownership: You retain 100% ownership of your original creations. OSBARD, INC. retains all rights to the software code, brand logos, assets, and characters.
• Data & Storage Responsibility: We do not backup your work. Your projects exist only in your browser’s local cache. Clearing your cache or hardware failure will result in permanent loss. You must manually export and save your work frequently.
• Third-Party Platforms: Use of osbard.com is also subject to Substack’s Terms of Use.
• Prohibitions: No illegal content; no reverse-engineering or scraping the site infrastructure.
• Disclaimers: Tools are provided “As-Is.” OSBARD, INC. is not liable for data loss or technical interruptions.
• Governing Law: Laws of the State of Tennessee. Disputes resolved in Nashville, TN.
